Service Dogs Under VA Rules and Idaho Law

For: Idaho veterans with trained service dogs
Subject: Where the dog may go, and what Idaho law protects

On VA property. VA must give trained service dogs access to its health care grounds.
No surcharge. Under Idaho Code 18-5812A, a carrier, hotel, cafe or landlord may not add a charge for a service dog.
Dogs still learning. Idaho Code 56-701A has a dog-in-training wear a jacket, collar, scarf or similar item that identifies it.
Faking it. Under Idaho Code 18-5811A, a person without a disability who uses a service dog to gain treatment or benefits as a person with a disability commits a misdemeanor.
Harming a service dog. Intentionally injuring or killing one is a misdemeanor under Idaho Code 18-5812: up to a year in county jail, a fine of up to $5,000 or both, plus restitution.

Renting in Idaho With a Veteran's Animal

Put the request in writing

Idaho has no statute of its own on emotional support animal paperwork, so a housing request rests on fair housing law. Ask in writing and keep a copy of every reply.

When you move out

Idaho Code 6-321 sets 21 days to return a deposit unless the lease fixes another time, and never more than 30 days. Money kept back needs a signed, itemized statement.
